Definitions and interpretations in these conditions

CSLMED stands for CSLMed.com.

‘Client’ means the person on whose behalf the booking is made and shall include the person or persons on whose behalf the booking is made. In terms of organizational purchasing, the customer therefore refers to both the purchasing organization and those who take the courses purchased for them by that organization.

“Courses” means any or all of the online courses, assessments or tutor-led courses purchased from CSLMED.

‘Force Majeure’ means any event beyond the control of CSLMED that prevents the immediate performance of its obligations, including war and civil strife, etc.

  1. Online English courses and assessments

Copyright and intellectual property rights

CSLMED through Specialist Language Courses Ltd owns or is licensed to use all intellectual property rights relating to the courses.

CSLMED through Specialist Language Courses Ltd retains the copyright to the courses and all rights, including but not limited to the right to publish, republish, broadcast, sell, distribute and use the courses in whole or in part in electronic and print editions throughout the world, in all languages ​​and in all media of expression now known or later developed, and to license or permit others to do so. Where CSLMED is a co-owner of the course copyright, this information is available upon request.

Reproduction, posting, transmission or other distribution or use of the courses in whole or in part, in any medium, requires the written permission of the copyright holders or, in the case of third-party materials, the owner of such content. Customers may not change or remove any copyright or other notice from copies of the content.

If customers believe that any material included in the courses may infringe the copyright of another party, please contact CSLMED by sending an email notice describing the alleged infringement to the following email: info@cslmed.com


A notice must include the following:

• a physical or electronic signature of the owner, or a person authorized to act on the owner’s behalf, of an exclusive right that is allegedly infringed;

• identification of the copyrighted work claimed to have been infringed, or, if the claim involves multiple works, a representative list of such works;

• identification of the allegedly infringing material in the Product;

• information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, or, if available, an email address;

• a statement that the complaining party believes that use of the materials in the manner complained of is not authorized by the copyright owner; It is

• a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Course updates

CSLMED through Specialist Language Courses Ltd reserves the right to update course content from time to time in order to ensure that the content is up to date, for example with any changes to operating procedures or technologies.


License for personal use

Customers can view this course electronically. Customers may, for personal use only, save to their individual storage medium and print course excerpts when necessary for personal learning purposes. Customers may not sell or distribute any course content without written permission from CSLMED.


Course availability

Courses are accessible online via PC, tablet, or smartphone for a defined period after the customer’s initial login. After purchase, the customer can access the course using the code provided by CSLMED. Customers can purchase extended access to courses upon request.

CSLMED through Specialist Language Courses Ltd uses a third party, Avallain AG, to host the courses. Customers use the Avallain website and content at their own risk. CSLMED is not responsible for the operation of the website, does not guarantee that the website will provide a continuous, fast, secure or error-free service, and assumes no responsibility, and will not be responsible for any damages or viruses that may affect computer equipment. users’ computing or other properties arising from the use of the courses, including, but not limited to, the reproduction of content.

CSLMED reserves the right to use an alternative Party to host the courses.

Links

Any electronic course links are provided for information and convenience only, and CSLMED has no control over, and therefore cannot accept responsibility for, the content of any third-party sites. CSLMED does not endorse any of the links.

2. Teacher-Led Online Courses and Oral Assessments

Closed group, individualized teaching, and oral assessments

CSLMED’s responsibility is to provide the oral instruction or assessment acquired by the client. There can be up to 1 month between booking a course and it starting. This is to allow CSLMED a reasonable amount of time to find the best possible teacher or examiner for the course.

All tutors and examiners will be qualified and experienced English teachers with a minimum of CELTA, Trinity TESOL, or equivalent teaching qualifications.
 

Postponing a class or assessment

To postpone a class or assessment, 2 working days’ notice is required, otherwise, the class or assessment will be canceled and there will be no refund or replacement of the class or assessment. Any change to the agreed time must be communicated to CSLMED in writing for confirmation with the teacher. A lesson or assessment may be rescheduled no more than 3 times in 1 course unless otherwise agreed in writing.


Delay

The teacher is obliged to wait 15 minutes after the agreed time for the class to start. If the client arrives within this period, the remaining time of the class will be taught – the delay time will be lost.

If the teacher is late for class for reasons beyond his control, for example, technical problems, he will make up for lost time at the end of the class or at a time agreed with the client. Every effort will be made to contact the customer to inform them of any delay in the class start time.


Open-group English courses

Open-group English courses are all teacher-led programs. The schedule and times for all courses are shown on the CSLMED website. Course materials used are at the discretion of CSLMED. Classes are taught on an online platform chosen by CSLMED.

The level of English for course entry is outlined on the CSLMED website and there is a link to an online English test to help customers make the decision to book the course. Customers can also speak to CSLMED to discuss their level of English before making a booking. CSLMED is not responsible for a customer purchasing a course and discovering that the level of the course does not meet their expectations.

Clients are expected to attend all classes to make the progress expected of them. CSLMED accepts no responsibility for any missed classes and no refunds will be given where classes are missed for any reason except in the case of Force Majeure.

For teacher-led courses to run, there must be a minimum booking of 6 clients. Any exception to this is at the sole discretion of CSLMED. If the course does not run due to insufficient bookings, customers will receive a full refund.

The minimum age to attend a course is 18 years old.


Teacher absence

When a teacher is sick or absent at pre-arranged times, such as holidays, CSLMED will arrange a replacement unless the client agrees otherwise in writing. CSLMED needs 3 working days to arrange a substitute teacher and can therefore rearrange the schedule to suit the client.

All changes to the schedule will be communicated immediately to customers.

Technical specifications

• Classroom Video Platform: Customers must use a PC or tablet to participate in teacher-led online courses and oral tests.

• Classroom software: CSLMED uses Zoom, an award-winning web conferencing platform. Zoom works on low internet connections, both with video and audio only. Zoom is now confidently used by more than 180,000 businesses and educational institutions around the world. Zoom is free to download and use.

Minimum requirements:

• Browser – Chrome, Firefox, Safari 5+, Internet Explorer 7+, Opera 12+

• Operating system – Windows XP/Vista/7/8/8.1/10, OSX 10.6.8+

• Tablet and mobile devices supported: iOS, Android and Blackberry devices, Surface PRO 2 with Win 8.1

• Speakers and microphone – built-in or plug-in USB or wireless bluetooth

• A webcam or HD webcam – built-in or USB plug-in

• Computer processor – any 1 GHz or better single-core processor

• Bandwidth requirements: The bandwidth used by Zoom is optimized for the best experience based on the participants’ network. It automatically adjusts for 3G, WiFi or wired environments. Recommended bandwidth:

• For 1:1 video calls: 600 kbps (upload/download) for HQ video and 1.2 Mbps (upload/download) for HD video

• For group video calls: 600 kbps/1.2 Mbps (upload/download) for HQ video. For gallery view: 1.5 Mbps/1.5 Mbps (upload/download)

• For screen sharing only (no video thumbnail): 50-75kbps

• For screen sharing with video thumbnail: 50-150 kbps

• For VoIP audio: 60-80kbps

• Firewall configuration: If Internet access has been restricted by administrators, ensure this domain is added to the firewall exception list:

Holidays

Classes will not be held on UK holidays. Fees are pro-rata and are not charged for these dates. A list of UK public holidays is available on the UK government website: https://www.gov.uk/bank-holidays.


Participation in the course: expectations

Customers are expected to behave in a courteous manner and to respect peers and teachers. Drug use, alcohol abuse and disrespectful behavior are considered unacceptable. CSLMED reserves the right to interrupt courses for any student who behaves in an offensive or abusive manner towards others. CSLMED reserves the right to close courses in these cases.

Course content, including technical, operational and related information, is provided for language learning purposes only. The information and materials contained in the courses do not constitute professional advice or opinion and should not be construed as such.

Although CSLMED has used its best efforts to ensure that the material and information contained in the courses were accurate at the time they were developed, no express or implied warranty is made that the information and materials in the courses, or on any other website or location referred to in the courses, is free from error or omission.

CSLMED does not accept any liability to any person for the use of information provided in the courses or incorporated into them by reference, or for any action or omission taken in reliance on the information in the courses. Customers must exercise their own skill and care in relation to the use of the information and materials contained in the courses.


Technical failures

CSLMED through Specialist Language Courses Ltd cannot be held responsible for partial or total loss of a course due to technical failures on the client’s side. If courses are missed due to technical problems with CSLMED or the teacher, the missing part will be rescheduled at the customer’s convenience.


Changes made by CSLMED

CSLMED will do its best to honor the agreements that have been confirmed, but must reserve the right to modify or cancel part or all of any course if unforeseen circumstances arise.

If CSLMED through Specialist Language Courses Ltd cancels or significantly changes part or all of the customer’s course for reasons of force majeure, CSLMED will inform the customer as soon as possible and offer the choice of an alternative course of at least a comparable standard, if available, a full refund or a prorated partial refund when part of the course has already been taught.


Changes made by the customer

If the customer wishes to change their booking in any way after the course has been issued, they must inform CSLMED immediately in writing and CSLMED reserves the right to charge £50 per person per change to cover the additional administrative costs involved. CSLMED also reserves the right not to fulfill the reservation in this case.


Limitations of Liability

CSLMED through Specialist Language Courses Ltd accepts responsibility for ensuring that all parts of the courses are provided as described and that all services reach a reasonable standard. However, they will not be responsible for the failure of these services where such failure is attributable to a) fault of the customer, b) unpredictable or unavoidable actions of an unconnected third party, c) unusual and unforeseeable circumstances beyond the control of CSLMED’s suppliers, including force bigger.

CSLMED through Specialist Language Courses Ltd specifically excludes all liability, to the fullest extent permitted by law, in respect of any loss or damage arising from reliance on the content of this course or any material or content accessed through it. Customers agree to indemnify, defend and hold harmless CSLMED, its directors, officers, employees or agents from and against all claims, causes, costs, expenses, fees (including reasonable attorneys’ fees), judgments, liabilities, losses and damages arising from or relating to the use of courses.


Choice of law

These Terms and Conditions and any counterparts, amendments or revisions shall be governed by and construed in accordance with English Law, without regard to principles of conflicts of law.


Privacy Policy

CSLMED and Specialist Language Courses Ltd collect the minimum amount of information about customers that is compatible with providing a satisfactory service. This Policy indicates the type of processes that may result from the collection of data about the customer. Your use of the courses gives CSLMED through Specialist Language Courses Ltd the right to collect this information.

Data collected in the UK is held in accordance with the Data Protection Act 2018, the implementation of the UK’s General Data Protection Regulation (GDPR). All reasonable precautions are taken to prevent unauthorized access to this information. This protection may require customers to provide additional forms of identity if they wish to obtain information about their account details.

Claims

If customers feel they have genuine reasons to complain, they should inform CSLMED as soon as possible. CSLMED will respond to all reasonable complaints and will do everything possible to resolve any issues. Unfortunately, CSLMED will not be able to respond to complaints made after the end of a course unless it was notified of this complaint while the customer was still studying the course and a reasonable opportunity was given to respond to that complaint at that time.


Cancellations and refunds

The customer can cancel their course and request a refund within 14 days after paying for access to a course, as long as they have not yet accessed the materials or started classes or completed an assessment. All refunds will be subject to a £50 administration fee and any associated bank charges. If the customer wishes to receive a refund, please make the request in writing, via email, to: info@cslmed.com

Refunds will be processed within 30 days of request.


Force majeure

CSLMED through Specialist Language Courses Ltd is not responsible for a party’s failure to perform its obligations if such failure is the result of natural disasters (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of enemies foreigners, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockade, embargo, labor dispute, strike, lockout or interruption or failure electricity or telephone service. Neither party has the right to terminate this Agreement in such circumstances.

If CSLMED declares Force Majeure as a reason for failure to fulfill its obligations, CSLMED will prove that it has taken reasonable steps to minimize delays or damage caused by foreseeable events, that CSLMED has substantially complied with all obligations, and that customers have been notified timely of the probability or actual occurrence of an event described in this Clause 12 (Force Majeure).
